Background to the seminar
On 20 December 2010, the Department of Labour published several bills proposing amendments to labour legislation for comment after being approved by cabinet. These included amendments to the Labour Relations Act (LRA), the Basic Conditions of Employment Act (BCEA), the Employment Equity Act (EEA) and the introduction of new legislation, the Employment Services Act (ESA), relating to temporary employment services and recruitment.
These bills represent the most far-reaching changes to the employment environment since the promulgation of the current legislation between 1995 and 1998. There are several critical provisions and changes that will have a major impact on the labour economy.
About your expert presenters
JOHN BRAND is a director and ADR specialist at Bowman Gilfillan. He has BA and LLB degrees from the University of the Witwatersrand and is also a director of Conflict Dynamics. He is a member of the advisory board of the African Centre for Dispute Settlement at Stellenbosch University and is on the executive committee of the National Dispute Settlement Practitioners Council. John is an International Mediation Institute certified mediator and also serves as a member on the IMI’s Independent Standards Commission. He specialises in dispute resolution and the training of negotiators, mediators and arbitrators and is a Centre for Effective Dispute Resolution accredited mediator.
Over the past 20 years, he has arbitrated and mediated many large commercial and employment disputes and he regularly facilitates negotiation, strategic planning and transformation processes.
He was a member of the International Labour Organisation’s team of international experts appointed to design mediation training for developing countries and he regularly trains mediators from countries in Africa, Asia, Eastern Europe and South America.
JAN MUNNIK is regarded as one of the leading experts in EE Transformation in South Africa. He is the Managing Director of EES-SIYAKHA and facilitated the development of The EES Process and Manual, which set an industry standard for the successful implementation of EE Transformation. EES-SIYAKHA has subsequently developed the most comprehensive EE Transformation process in the market, which not only ensures Top Management leadership, but also the implementation of “best HR Practices”, and effective change management. Jan has delivered papers at numerous conferences on EE and BEE. He consults to a number of prominent organisations and Government institutions. Jan also specialises in BEE strategy development, which he has facilitated for numerous clients in the private sector.
